Xmedia - Terms & Conditions

This agreement represents the complete agreement between xmedia corporation (hereinafter called xmedia) and the Client.

Terms of Agreement

xmedia is renting bandwidth and web space to the client.
This agreement becomes effective when the clients account is activated.
The client will be responsible for ethical use of the network connectivity provided by xmedia.
The client agrees not to use the connectivity services provided by xmedia, to violate any city, state, or, federal laws.
In consideration for the privilege of using xmedia's Internet service and in consideration for having access to the information contained on it, the Client hereby releases xmedia, from any and all claims of any nature arising from the use, or inability to use, the Internet connection.
The Client will indemnify xmedia for any loss suffered by reason of improper use of the Internet connection and will compensate anyone harmed by any abusive use of the Internet connection.
xmedia may deny access to any Client who does not provide accurate information for opening the account.
xmedia reserves the right to change the terms and conditions of this service agreement by notifying Client in writing or by email at least 30 days in advance of the effective date of the change. Use of the service by the Client after the effective date constitutes acceptance of the new terms and conditions. If the Client does not agree to the new terms and conditions, the Client may cancel this agreement at any time by giving xmedia proper written notice in accordance with the terms and conditions stated herein.
xmedia reserves the right to review any material stored in files or programs to which other users have access and will edit or remove any material that, in its sole discretion, believes may be unlawful, obscene, abusive, or otherwise objectionable.
xmedia reserves the right to revoke access for any abusive conduct or fraudulent use of the Internet connection.
xmedia does not warrant that the functions of the Internet connection will meet any specific requirements that the Client may have, nor that the Internet connection will be error free or uninterrupted, nor shall xmedia be liable for any indirect, incidental or consequential damages (including lost data, information, or profits) sustained or incurred in connection with the use of, operation of, or inability to use the Internet connection.

Billing Policies

xmedia will bill the Client based on their choice of Account. Please refer to the xmedia rate schedule.
xmedia will accept payment made by personalized cheque, money order, cash, VISA, Mastercard, or, American Express.
xmedia will charge an additional $20.00 for returned cheques.
xmedia will charge an additional $20.00 (ten dollars) per month on overdue accounts. Accounts are considered overdue after the tenth day of the month.
If an account is in arrears for 60 days, the account will be closed and charged with an additional month's services.
Payments are due on the first of each month.
